"The restaurant had nothing to do with the fraud"

Below is a story that sparked our eye. Within the story one police officer states: "the restaurant had nothing to do with the fraud" Supposedly some Romanian was able to hack into the restaurant and steal the credit card information from customers. This is something that the restaurant can prevent by following the 1st step to the PCI data security requirements: "you must install and maintain a secure network firewall to protect data..."
